RULES OF THE “CHRISTMAS 2022: TRIP TO NEW YORK” PROMOTION

TERMS AND CONDITIONS OF THE "CHRISTMAS 2022: TRIP TO NEW YORK" PROMOTION

The entity Live Out Solutions, S.LSIWON (hereinafter SIWON), a validly constituted company with registered office at Paseo de la Castellana, 194, 28046 Madrid, with tax identification number B88631049, will carry out a promotion that will be developed in accordance with the provisions of these terms and conditions.

  1. The objective of this promotion is to raise awareness and encourage users to place an order on the company's website.
  2. The promotion will take place throughout the EU territory, and all users who place an order of 50 euros or more (final amount paid including VAT) and accept these Legal Terms and Conditions may participate.
  3. Promotion period: From December 1, 2022 to January 5, 2023, both dates inclusive (hereinafter, “Promotional Period”). Notwithstanding the foregoing, SIWON reserves the right to modify the Promotion dates at its discretion.


HOW TO PARTICIPATE AND MECHANICS
To participate, you must place an online order for products or packs at www.getsiwon.com Orders of €50 or more are eligible. Each order placed during the promotional period that meets the minimum amount requirement will receive one entry into the prize draw. Users may obtain as many entries as they wish. Siwon reserves the right to reject any registration at its discretion and without prior notice if it deems it defective. For the entry to be valid, the order cannot be canceled (cancelled orders will not be entered into the prize draw).

PRIZE
One (1) trip to New York for two (2) people will be raffled off. The prize includes round-trip airfare from Madrid-Barajas Airport, as well as four nights' hotel accommodation. Transfers (airport-hotel), meals, activities, and travel insurance are not included.
The prize is non-transferable and cannot be exchanged for cash.

DRAW AND NOTIFICATION OF THE WINNER
The winner will be selected by a random draw using the EasyPromos app or a similar platform from among the users who have met the participation requirements. Participants who have not followed all the steps of the contest will be automatically disqualified.
The random drawing to determine the winner will be held on January 11, 2023. In addition, one (1) extra participant will be drawn, who will be considered an alternate or reserve in case the initially drawn winner declines the prize, does not meet the requirements established in the rules, or cannot be contacted.

The winner will be contacted by email within one week of the draw. If the winner cannot be located or contacted within seven (7) calendar days of Siwon's notification, the prize will be awarded to the next eligible participant, and the original winner will be deemed to have irrevocably waived the prize. If the alternate participant cannot be located within a further seven (7) calendar days of Siwon's notification, the prize will be forfeited.

Any tax charges that the acceptance of the prize may entail, as well as any other expenses arising from the Promotion that are not expressly assumed by Siwon in these Legal Terms, will be borne by the winner.

ADVERTISING
SIWON reserves the right to publish the winner's username for promotional purposes.

OTHER CONDITIONS

  1. Participation in the draw implies full acceptance of these terms and conditions. The prize for this promotion is not redeemable for cash and will be subject to applicable tax withholdings.

  2. The prize is personal and non-transferable. The prize must be accepted by the winner or their designated representative.

  3. Siwon is not responsible for any technical problems that may occur in its subsequent operation or for any costs that may arise from it.

  4. Participation in the promotion necessarily implies acceptance of these terms and conditions and Siwon's interpretative criteria regarding the resolution of any issue arising from this promotion.

  5. Facebook, Instagram, and TikTok do not sponsor, endorse, or administer this Promotion in any way, nor are they associated with it; they simply serve as amplifiers. Participants acknowledge that they are providing their information to Siwon, which will only use it to manage their participation in this promotion, to inform them of other promotions, and to send them the prize if they are a winner. Facebook is exempt from all liability to contestants and participants.

  6. Only individuals over 18 years of age residing in the European territory (EU) may participate.

  7. Siwon is not responsible for possible failures in participation due to an Internet malfunction, or any other cause, such as interruptions, slowdown, unregistered entries due to incompleteness or other reasons, unauthorized access or errors in receiving any information, nor for any damages that may be caused to the user.

  8. Siwon reserves the right to modify or expand these promotional terms, provided that it does not harm or diminish the rights of the Participants in the Promotion.

  9. Participation in the Promotion implies full acceptance of these Legal Terms and Conditions by the Participants who register for this Promotion, which may be formalized in a Notarial Deed and will be available to anyone who wishes to consult them.

  10. These Terms and Conditions shall be interpreted and governed in accordance with Spanish law. The Courts of the city of residence of the Participants shall have jurisdiction to resolve any claim or dispute that may arise in relation to the validity, interpretation or fulfillment of these terms and conditions.
